(I am not a lawyer.) Food/drinks are forbidden on Washington, DC, Metro and on PATH trains. Alcohol is tolerated on MTA LIRR/MetroNorth, because they're railroads like Amtrak (including stations). read more

I don't know the laws and regulations governing whether or not you are allowed to eat in the subway, but if any exist, they are completely ignored and never enforced. read more

However, New York has remained on a heightened state of alert since September 11, 2001. New MTA Rules Subway riders will also have to brave the morning commute without their coffee.
