I agree with John Robinson on his ID. It's an orange morph of the garden cross spider (Araneus diadematus). A female, either badly starved or dying after laying eggs (which they usually do in autumn in colder climates). They're usually more globular when well-fed and ready to lay eggs. read more

The orange morph of A. diadematus can also be confused with the similarly orange marbled orbweaver (Araneus marmoreus), but they have very different abdominal markings.
